Terms of Service - User Agreement

1. Agreement to Terms

By accessing or using Nano Banana's AI image generation service at nano-banana.love (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and Nano Banana.

2. Description of Service

Nano Banana provides an AI-powered image generation platform that allows users to create images from text prompts or edit existing images using artificial intelligence technology. The Service includes paid subscription tiers with varying features and usage limits.

3. Account Registration and Security

You must be at least 13 years old to create an account and use our Service. If you are under 18, you must have parental or guardian consent.
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must notify us immediately of any unauthorized use of your account or any other security breach.

4. Subscriptions, Payments, and Credits

Paid features of the Service are available through subscription plans. All payments are processed by Creem, our Merchant of Record.

Subscription fees are billed in advance on a monthly or annual basis, depending on your selected plan.
Each subscription plan includes a monthly allocation of credits for image generation. Credits refresh monthly and unused credits roll over to the next billing period.
Subscriptions automatically renew unless cancelled before the renewal date. You authorize Creem to charge your payment method for recurring fees.
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.
We offer a 14-day refund policy for paid subscriptions, provided you have not used any credits during the current billing cycle. If any credits have been consumed, the subscription payment is non-refundable.

5. Acceptable Use Policy

You agree not to use the Service to generate, upload, or distribute content that:

Is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
Contains explicit sexual content, violence, or content harmful to minors
Infringes on intellectual property rights, trademarks, or copyrights of others
Attempts to exploit, harm, or abuse our AI systems or circumvent usage limits
Impersonates any person or entity, or falsely states or misrepresents your affiliation

6. Intellectual Property Rights

The Service, including its original content, features, and functionality, is owned by Nano Banana and protected by copyright, trademark, and other intellectual property laws.

Subject to your compliance with these Terms, you retain ownership of the images you generate using the Service. You grant us a limited license to store, process, and display your content as necessary to provide the Service. We do not claim ownership of your generated images.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NANO BANANA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

9. Indemnification

You agree to indemnify, defend, and hold harmless Nano Banana and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall remain in effect.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Nano Banana operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of the applicable jurisdiction.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page with a new effective date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
