Terms of Service

1. Who we are

Nano Banana is an independent service. We are not affiliated with, endorsed by, or sponsored by Google or any other AI model provider. Model names such as Nano Banana, Gemini, Veo, GPT Image, Seedream, Seedance, Grok, and Kling are trademarks of their owners and are used only to identify the models we offer.

2. Eligibility and accounts

• You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you are under 18, you need a parent's or guardian's permission.
• You agree to provide accurate information and to keep your sign-in method secure. You are responsible for all activity under your account.
• Tell us right away at support@nano-banana.love if you notice unauthorized use of your account.
• One person may not create multiple accounts to claim additional free credits or to get around a suspension.

3. The Service

Nano Banana lets you generate and edit images and videos with third-party AI models, including text-to-image, image editing, style presets, upscaling, background and watermark removal, image captioning, and image-to-video. We provide the interface, prompt tools, and generation history; the models themselves are run by third-party providers.

AI output can be inaccurate, unexpected, or similar to content generated for other users. Results are not guaranteed to match your prompt or to be suitable for any particular purpose.

We may change, add, suspend, or remove features, models, styles, credit costs, and processing times at any time. If a model provider stops offering a model, we may replace or remove it.

4. Credits and free usage

• Generations use credits. The cost depends on the model and options you choose and is shown before you generate.
• New accounts may receive free sign-up credits. We decide eligibility automatically using account, IP address, location, and device signals, and we may decline, limit, or remove free credits obtained through multiple accounts, automation, or other abuse.
• Free usage may come with limits, such as waiting time between generations, watermarks on downloads, or restricted features. Paid features are listed on the Pricing page.
• If a generation fails to complete, the credits charged for it are returned to your balance automatically.
• Credits have no cash value and cannot be transferred, sold, or exchanged for money, except where the law requires otherwise. We may rate-limit, queue, or refuse generation to protect the Service or stop abuse.

5. Credit packs and billing

Payments are processed by Waffo Pancake, which acts as the Merchant of Record for your purchase. Prices are shown in US dollars before you pay, and any applicable taxes are calculated at checkout.

• One-time credit packs: Each pack is a single charge for the number of credits shown on the Pricing page. Packs do not renew, and nothing further is charged unless you buy again.
• Credits never expire: Purchased credits do not expire while your account is open and in good standing.
• Price changes: We may change pack prices at any time. A change never affects packs you have already bought.

6. Refunds

You can request a full refund within 14 days of a purchase if none of the credits from that purchase have been used. Email support@nano-banana.love with the email address on your account and your order ID. Once any credits from a purchase have been used, that purchase is non-refundable. When a refund is issued, the credits from that purchase are removed from your balance.

Regardless of the above, we will always put things right in these cases:

• A payment that succeeded but whose credits never reached your account: we add the credits or refund the charge.
• A duplicate charge, or a charge caused by a clear error on our side.
• A generation that did not complete: the credits are returned to your balance.

Refunds are issued by Waffo Pancake to your original payment method. If you open a chargeback or payment dispute instead of contacting us first, we may suspend your account and hold unused credits while the dispute is open. Please email us first; most billing problems are faster to fix directly.

Nothing in these Terms limits any refund, cancellation, or withdrawal right you have under mandatory consumer protection law where you live.

7. Your content

You keep the rights you have in the prompts and images you submit ("Input"). You grant us a limited, worldwide license to host, process, store, transmit to our AI providers, and display your Input and results only as needed to operate the Service for you.

You confirm that you own or have permission to use everything you upload, including the consent of any identifiable person shown, and that your Input does not infringe anyone's rights or break the law.

We do not use your Input or results to train AI models, and we do not sell them. How we handle personal data is described in our Privacy Policy.

8. Generated output and commercial use

• As between you and us, you own the images and videos you generate ("Output"), to the extent the law allows. We do not claim ownership of your Output.
• Commercial use rights and watermark-free downloads come with purchased credit packs, as listed on the Pricing page. Output created with free credits may include a watermark and is for personal, non-commercial use.
• AI-generated content may not be protected by copyright in some countries, and similar Output may be generated for other users. You are responsible for making sure your use of Output does not infringe trademarks, copyrights, or anyone's likeness or privacy rights.
• Your use of Output must also follow the usage rules of the model provider that created it.

9. Content standards

The categories below are prohibited. They apply to what you upload, what you ask us to generate, the results we return, and what you then share. Prohibited means not allowed at all, not even with a warning, a disclaimer, or a private setting.

• Sexual content and nudity: No nudity, sexual acts, or sexualized imagery, and no requests to undress, "nudify," or sexualize a real person shown in a photo.
• Child safety: Never upload or request sexualized or exploitative content involving anyone under 18. Do not upload a photo of a child unless you are their parent or guardian. Child sexual abuse material is illegal: we remove it, terminate the account without notice, preserve evidence, and report it to law enforcement and NCMEC or the equivalent authority.
• Non-consensual deepfakes and impersonation: Only swap or edit the face of a real person with their consent. Do not create content that impersonates someone, implies an endorsement they did not give, shows a real person in a sexual, humiliating, or defamatory way, or presents an AI-edited image as authentic where that would mislead, including news, political content, evidence, identity documents, dating profiles, or fraud.
• Violence and self-harm: No gore, graphic injury, threats, or content that promotes self-harm or violence against real people.
• Hate and extremism: No content that attacks or dehumanizes people based on race, ethnicity, national origin, religion, caste, sex, gender identity, sexual orientation, disability, age, or serious illness, and no hate symbols or extremist or terrorist propaganda.
• Harassment and privacy: No bullying, stalking, doxxing, or using someone's private photos without permission.
• Intellectual property: No uploads of photos, artwork, or stock images you have no rights to, no reproduction of logos, brand marks, or protected characters you are not authorized to use, and no use of the watermark remover or other tools to strip watermarks, logos, or copyright notices from images you do not own or have permission to edit.
• Illegal activity: No scams, fake documents, malware, spam, or any other unlawful use.

10. Other prohibited conduct

You also agree not to:

• Bypass or test our content filters, rate limits, credit system, or security controls, including through prompt wording designed to evade the content standards.
• Create multiple accounts or use automation to claim free credits.
• Scrape, reverse engineer, overload, or disrupt the Service or its infrastructure.
• Run automated or bulk generation, or resell or wrap access to the Service, without our written permission.

11. Reporting, moderation, and copyright complaints

To report content or an account that breaks these Terms, including a photo of you that someone else uploaded, email support@nano-banana.love with "Content report" in the subject line. Tell us what you saw, where you saw it, and, if you have it, the image or link. You do not need an account to report, and good-faith reports are never held against you.

We acknowledge reports within 3 business days and tell you the outcome when the review is finished. Reports about your own likeness, non-consensual sexual content, or minors are prioritized and reviewed as soon as we see them.

Moderation works in layers. Every prompt and upload passes automated safety checks, and model providers apply their own filters, so most violating requests fail before anything is generated. Our team reviews every report we receive, along with accounts that repeatedly trip the safety filters or are flagged by a payment dispute or legal request, and may open the prompts, uploads, and results attached to that account for the review. We do not routinely browse content that nobody has reported.

Copyright complaints: email support@nano-banana.love with "Copyright complaint" in the subject line and include (1) the work you believe is infringed, (2) the material you want removed and where it is, (3) your contact details, (4) a statement that you believe in good faith the use is not authorized, and (5) a statement, under penalty of perjury, that your notice is accurate and that you are the rights holder or authorized to act for them, with your physical or electronic signature. If your content was removed and you believe that was a mistake, you can send a counter-notice to the same address. We terminate the accounts of repeat infringers.

12. Enforcement and appeals

If we believe you have broken these Terms, or that your use of the Service is unlawful, creates legal risk, or harms other users or the Service, we may take one or more of these steps, choosing what is proportionate:

• Warn you or ask you to stop.
• Remove or delete the prompts, uploads, or results involved.
• Limit, rate-limit, or pause your ability to generate.
• Suspend your account, temporarily or while we investigate.
• Terminate your account.
• Report the matter to law enforcement where the law requires it or someone is at risk.

We will normally warn you first and, where we reasonably can, tell you why we acted. We may act immediately and without notice for illegal content, sexual content involving a minor, threats to someone's safety, or risks of serious harm.

If you think we got it wrong, email support@nano-banana.love within 30 days with "Appeal" in the subject line. Where possible, someone not involved in the original decision reviews the appeal. If we agree we made a mistake, we restore your content, account, and any credits spent on it.

13. Suspension and termination

• You can stop using the Service at any time and ask us to delete your account by emailing support@nano-banana.love.
• We may suspend or terminate your access if you break these Terms, abuse generation capacity or free credits, create legal risk, or if we discontinue the Service.
• If we suspend or terminate your account because you broke these Terms, unused credits are forfeited and not refunded, except where the law requires otherwise. If we close your account for any other reason, such as discontinuing the Service, we will give you reasonable notice and a fair chance to use the credits you bought.
• After an account is closed, we delete or de-identify your data as described in our Privacy Policy.
• Sections that by their nature should survive termination, including content license, intellectual property, disclaimers, limitation of liability, and indemnification, will survive.

14. Our intellectual property

The Service, including our branding, site design, software, prompt tools, and documentation, is owned by Nano Banana or our licensors and is protected by intellectual property laws. These Terms do not transfer any of those rights to you.

15. Third-party services

We rely on third parties for AI generation (WaveSpeed, Kie.ai, and the model developers behind them), payments (Waffo Pancake), sign-in (Google), database (Supabase), email (Resend), and hosting. Their own terms, privacy policies, and content rules may also apply to your use of the Service. We are not responsible for third-party services we do not control.

16. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, ORIGINAL, OR INOFFENSIVE, THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT UPLOADS OR RESULTS WILL NEVER BE LOST. YOU ARE RESPONSIBLE FOR REVIEWING OUTPUT BEFORE YOU RELY ON OR PUBLISH IT.

17. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NANO BANANA AND ITS OPERATORS, AFFILIATES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE THREE MONTHS BEFORE THE CLAIM OR (B) USD $50.

Some jurisdictions do not allow certain limitations. In those places, our liability is limited to the fullest extent the law permits.

18. Indemnification

You agree to defend, indemnify, and hold harmless Nano Banana and its operators from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your Input, your use of Output, your misuse of the Service, or your violation of these Terms, the law, or the rights of a third party.

19. Governing law and disputes

Before filing any claim, please email support@nano-banana.love and give us 30 days to try to resolve the issue informally. Most problems can be fixed this way.

These Terms are governed by the laws of the place where Nano Banana principally operates, without regard to conflict-of-law rules, except where mandatory consumer protection laws of your country of residence apply.

20. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date on this page, and we may announce material changes through the Service or by email. Continued use after the changes take effect means you accept the updated Terms.

21. General

These Terms, together with our Privacy Policy and the Pricing page, are the entire agreement between you and Nano Banana about the Service. If a provision is found unenforceable, the rest remain in effect. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Our failure to enforce a provision is not a waiver.
